These Terms and Conditions ("Terms") outline the rules and regulations for the use of the FODMAPai mobile application ("App"). By downloading, installing, or using this App, you accept these Terms and Conditions in their entirety.

• "App", "FODMAPai", "Application", "Service": Refers to the FODMAPai mobile application for iOS devices.
• "Company", "We", "Us", "Our": Refers to LinTech, the developer and operator of FODMAPai.
• "User", "You", "Your": Refers to you, the person who downloads, installs, and uses this App.
• "Device": Refers to any iOS device (iPhone, iPad, iPod Touch) on which the App is installed.
• "Health Data": Refers to food logs, symptom records, bowel movement data, stress levels, and any other health-related information entered into or generated by the App.
• "AI Services": Refers to artificial intelligence and machine learning services used for food analysis, FODMAP estimation, and health insights.

2. MEDICAL DISCLAIMER AND HEALTH INFORMATION
⚠️ IMPORTANT: FODMAPai is designed strictly for educational, informational, and personal tracking purposes only.
The App is NOT:
• A substitute for professional medical advice, diagnosis, or treatment
• A medical device or diagnostic tool
• Intended to diagnose, treat, cure, or prevent any disease
• A replacement for consultation with qualified healthcare providers
• Intended to provide emergency medical services
Healthcare Provider Consultation Required:
You MUST consult with a qualified healthcare provider, registered dietitian, or gastroenterologist before:
• Making any dietary changes based on App information
• Starting or modifying a Low FODMAP diet
• Using the App's insights to guide treatment decisions
• Discontinuing any prescribed medications or treatments
• Self-diagnosing any medical condition
Emergency Medical Situations:
DO NOT rely on this App for emergency medical situations. If you experience severe symptoms, seek immediate medical attention:
• Severe abdominal pain
• Bloody stools or rectal bleeding
• Persistent vomiting
• Signs of dehydration
• Unexplained weight loss
• High fever
• Inability to pass stool or gas
Call emergency services (911 in the US, 112 in Europe) or go to the nearest emergency room immediately.

3. ARTIFICIAL INTELLIGENCE AND ANALYSIS LIMITATIONS
AI Technology Used:
FODMAPai uses artificial intelligence and machine learning services (provided through OpenRouter API) to:
• Analyze food descriptions and images
• Estimate FODMAP content in foods
• Identify ingredients in photographs
• Provide dietary insights and pattern analysis
• Generate food recommendations
• Assist with menu scanning and interpretation
AI Accuracy Limitations:
⚠️ AI analysis is not 100% accurate. You acknowledge that:
Food Identification: AI may misidentify foods in images, especially with:
• Poor lighting or image quality
• Similar-looking foods
• Mixed dishes or complex preparations
• Regional or uncommon food varieties
FODMAP Estimates: AI-provided FODMAP levels are estimates that may not reflect:
• Specific brand formulations
• Cooking methods that alter FODMAP content
• Serving size variations
• Ripeness or preparation differences
Pattern Recognition: AI insights about symptom triggers are correlational, not causal, and may:
• Identify false correlations
• Miss actual trigger foods
• Not account for confounding variables
• Be influenced by incomplete data
Verification Required:
You are strongly encouraged to:
• Verify all AI analysis results with official sources
• Cross-reference FODMAP levels with the official Monash University FODMAP Diet App
• Consult food packaging and ingredient labels
• Discuss findings with healthcare providers

4. FODMAP INFORMATION AND RESEARCH BASIS
Research Foundation:
FODMAPai uses publicly available FODMAP research and data, including information from academic publications, nutritional databases, and FODMAP research conducted primarily by Monash University and other research institutions.
Not Officially Endorsed:
⚠️ IMPORTANT: This App is NOT officially endorsed, affiliated with, or approved by Monash University or any other research institution.
Official FODMAP App Recommendation:
For the most accurate and up-to-date FODMAP information, we recommend using the official Monash University FODMAP Diet App alongside FODMAPai. The official Monash app should be considered the authoritative source for FODMAP content information.
FODMAP Diet Guidelines:
The Low FODMAP diet is:
• A therapeutic diet intended to be temporary (typically 6-8 weeks elimination phase)
• Designed to be implemented under the guidance of a registered dietitian
• Not intended as a permanent dietary restriction
• Most effective when followed with professional supervision
• Meant to be followed by a reintroduction phase
DO NOT undertake a Low FODMAP diet without consulting a healthcare provider or registered dietitian specializing in digestive health.
Data Variability:
FODMAP content in foods can vary based on ripeness, cooking methods, serving sizes, brand formulations, and regional variations.

5. USER ACCOUNTS AND API KEYS
OpenRouter API Key Requirement:
To use AI-powered features (food analysis, image recognition, chat assistant, menu scanning), you may need to:
• Obtain your own OpenRouter API key from OpenRouter.ai
• Enter and store your API key in the App's settings
• Accept OpenRouter's terms of service and privacy policy
• Understand that API usage may incur costs charged by OpenRouter
API Key Security:
You are responsible for:
• Keeping your API key confidential
• Not sharing your API key with others
• Monitoring your API usage and associated costs
• Securing your device against unauthorized access
• Revoking compromised API keys immediately
Age Requirements:
You must be at least 13 years of age to use this App. If you are between 13-18, you must have obtained parental/guardian consent.

6. PRIVACY AND DATA HANDLING
Privacy-First Design:
FODMAPai is designed with privacy as a core principle:
• Local Storage: All Health Data is stored locally on your device using SwiftData
• No Cloud Sync by Default: Data is not automatically uploaded to cloud servers
• Optional iCloud: If enabled, data may sync via your personal iCloud account
Data Collection:
The App collects and stores locally on your device:
• Food entries (name, description, images, FODMAP levels, timestamps)
• Ingredient information and quantities
• Symptom logs (type, severity, timing, notes)
• Bowel movement records (Bristol Stool Scale type, timing)
• Stress level entries
• Medication and supplement logs
• Health profile information
• App preferences and settings
• API keys (stored securely in iOS Keychain)
Data Transmission to Third Parties:
When you use AI features, the following data is transmitted to third-party AI services (OpenRouter):
• Food descriptions and names
• Food photographs (for image analysis features)
• Menu images (for menu scanning features)
• Chat messages and queries
• Context data for personalized insights
⚠️ IMPORTANT: This data transmission occurs only when you actively use AI features.
Zero Data Retention (ZDR):
FODMAPai implements Zero Data Retention by default:
• All API requests to OpenRouter include ZDR parameter
• OpenRouter processes requests but DOES NOT store your data
• Your Health Data is NOT retained by AI service providers
• Data is NOT used for training AI models
• Requests are NOT logged by third-party providers
No Analytics or Tracking:
We do NOT collect:
• Usage analytics or telemetry
• Personally identifiable information (PII) for marketing
• Location data
• Device identifiers for tracking purposes
Camera and Photo Access:
The App requests access to your camera and photo library to scan food images for FODMAP analysis. Photos are processed locally or sent to AI services for analysis only.
Data Ownership and Control:
You retain full ownership of all Health Data you create in the App. You have the right to:
• Access all your data at any time
• Export your data (CSV, JSON, or PDF formats)
• Delete specific entries or all data
• Disable AI features and use the App offline

7. INTELLECTUAL PROPERTY RIGHTS
Ownership:
LinTech AS and/or its licensors own all intellectual property rights in the FODMAPai App, including but not limited to:
• Source code and software
• App design, UI/UX, and graphics
• Documentation and help content
• Trademarks, logos, and branding
License Grant:
We grant you a limited, non-exclusive, non-transferable, revocable license to:
• Download and install the App on your personal iOS device(s)
• Use the App for personal, non-commercial purposes
• Access and use App features as intended
Restrictions:
You must NOT:
• Republish, redistribute, or resell any part of the App
• Copy, modify, or create derivative works
• Reverse engineer, decompile, or disassemble the App
• Remove or alter copyright notices
• Use the App for commercial purposes without authorization
• Rent, lease, lend, or sublicense the App to third parties
User-Generated Content:
You retain ownership of data and content you create in the App. We do NOT claim ownership of your Health Data or personal information.

8. ACCEPTABLE USE POLICY
Permitted Uses:
You may use FODMAPai for:
• Personal health tracking and dietary management
• Logging foods, symptoms, and bowel movements
• Analyzing FODMAP content in foods
• Tracking patterns over time
• Sharing data exports with your healthcare providers
Prohibited Uses:
You must NOT use the App to:
• Diagnose or treat medical conditions
• Provide medical advice to others
• Replace professional healthcare services
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Upload malicious code, viruses, or harmful content
• Interfere with other users' use of the App
• Use automated systems (bots, scrapers) to access the App

9. IN-APP PURCHASES AND PAYMENTS
Free Features:
FODMAPai offers core features for free, including:
• Basic food logging
• Symptom tracking
• Local data storage
• Manual entry of FODMAP levels
AI Features and API Costs:
AI-powered features require:
• An OpenRouter API key (included in the app free of charge for a limited period)
• Internet connectivity
• Acceptance of third-party terms and costs
Apple App Store Terms:
All payments and transactions are processed through Apple's App Store and are subject to Apple's Terms of Service.

10. DISCLAIMERS AND WARRANTIES
"As Is" Basis:
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.
No Warranties:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:
• Accuracy: We do not warrant that App Content is accurate, complete, or error-free
• Availability: We do not warrant uninterrupted or error-free operation
• Fitness for Purpose: We do not warrant the App will meet your requirements
• Health Outcomes: We make no warranties regarding health improvements or symptom relief
No Guarantee of Results:
We do NOT guarantee:
• Identification of trigger foods
• Symptom improvement
• Weight loss or health benefits
• Accuracy of FODMAP analysis
• Successful dietary management

11. LIMITATION OF LIABILITY
Maximum Liability:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LINTECH BE LIABLE FOR:
• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Personal injury or death (except where prohibited by law)
• Health complications, medical expenses, or treatment costs
• Reliance on App content or analysis
• Third-party service failures
• Data loss, corruption, or breaches
Aggregate Liability Cap:
OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED the greater of: (a) $100 USD, or (b) the amount you paid us in the 12 months preceding the claim.
Health and Safety:
WE ARE NOT LIABLE FOR:
• Medical decisions made based on App information
• Delays in seeking medical care
• Adverse health outcomes
• Allergic reactions or food intolerances
• Worsening of medical conditions

12. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless LinTech from any claims, liabilities, damages, losses, costs, or expenses arising from:

• Unauthorized access to your device or API keys

Third-Party Services:
The App uses third-party services including:
• OpenRouter: AI/ML API service (https://openrouter.ai/)
• Apple iCloud: Optional cloud synchronization

Your use of third-party services is subject to their respective Terms of Service and Privacy Policies.
No Responsibility for Third Parties:
We are NOT liable for:
• Third-party service outages or failures
• Third-party data breaches or security issues
• Third-party billing or payment disputes
• Changes to third-party services or APIs

14. MODIFICATIONS TO TERMS AND APP
Terms Updates:
We reserve the right to modify these Terms at any time. When we make changes:

We may, at any time:
• Update, modify, or discontinue App features
• Change UI, design, or functionality
• Add or remove third-party integrations
• Adjust AI models or analysis methods

15. TERMINATION
Termination by You:
You may terminate your use of the App at any time by uninstalling the App from your device.
Termination by Us:
We may suspend or terminate your access for:
• Violation of these Terms
• Prohibited or illegal use

• At our discretion, with or without cause
Effect of Termination:
Upon termination:
• Your license to use the App immediately ends
• You must stop all use of the App
• Data stored locally on your device will remain until you delete it

16. DISPUTE RESOLUTION AND GOVERNING LAW
Governing Law:
These Terms shall be governed by the laws of Norway, without regard to conflict of law principles.
Jurisdiction and Venue:
Any legal action shall be brought exclusively in the courts located in Norway, Agder Tingrett.
Informal Resolution First:
Before filing any legal claim, you agree to contact us at support@fodmapai.com to attempt informal resolution for at least 30 days.
Class Action Waiver:
YOU AGREE TO BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION.
Time Limitation:
You must bring any claim within ONE (1) YEAR after the claim arises, or it is permanently barred.

17. GENERAL PROVISIONS
Entire Agreement:
These Terms, together with our Privacy Policy and Medical Disclaimer, constitute the entire agreement between you and LinTech AS.
Severability:
If any provision is found unenforceable, it shall be modified to the minimum extent necessary, and remaining provisions remain in effect.
Assignment:
You may NOT assign these Terms without our consent. We may assign these Terms to affiliates or in connection with a merger or acquisition.
Force Majeure:
We are not liable for failure to perform due to circumstances beyond our control, including natural disasters, government actions, or third-party service outages.

18. APPLE APP STORE REQUIREMENTS
Acknowledgment:
• These Terms are between you and LinTech AS, not Apple
• Apple is not responsible for the App or its content
• Apple has no obligation to provide maintenance or support
• Apple is not liable for any claims relating to the App
Third-Party Beneficiary:
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them.

If you do not agree to these Terms:

• Uninstall the App if already installed
